What’s Coming

On February 28, the Supreme Court heard oral arguments in one of the most significant environmental battles of the decade: West Virginia v. EPA. The highly-anticipated decision not only could address the EPA’s ability to regulate greenhouse gases from power plants, but also, more significantly, could rule on whether Congress can legally delegate broad regulatory authority to federal agencies.

With so much on the line, we’re preparing an all-star panel to discuss this case, the ruling, and what it will mean moving forward.

Our esteemed panel, moderated by Harvard Law professor Richard Lazarus, will feature a team of leading environmental and appellate lawyers who argued and/or briefed on behalf of the various interested parties. Through a series of posed questions, we’ll engage in a high-level, balanced discussion with true insiders’ perspectives you won’t find anywhere else.

Topics include:

  • Key take-aways from the majority and dissenting opinion(s)
  • Whether oral argument is a reliable predictor of the court’s ruling
  • EPA’s Clean Air Act authority to address climate change
  • Portent of ruling for the role of states to address climate change
  • Impact of ruling on ongoing industry efforts to address climate change
  • Reflections on SCOTUS (time permitting)
    • Environmental law beyond the Clean Air Act
    • Administrative law in general
    • The Court itself
